Please read these terms. By downloading, opening or using Arkadia you agree to them. If you do not agree, do not use the app.
They are written in plain language on purpose. Plain language is still binding.
Arkadia is a mobile app containing several arcade games. The distinctive part is that you draw the artwork used in the games yourself.
Anyone can play Arkadia. Every game, the drawing tools, and everything you earn by playing are available at any age.
Community features will be 13+. Publishing a design where other players can see or use it, and browsing designs other players made, will require you to be at least 13 years old, or older, if the minimum age where you live is higher. Neither feature is in the app yet. There is an optional birth year field in Settings, which is how this will be applied when they arrive.
If you are under 18, you should have a parent or guardian's permission to use Arkadia.
If we learn that someone under 13 has used the community features, we will remove their content and close their access to those features.
You can play without an account, and you always will be able to. If you choose to connect one, you are responsible for what happens under it, and for keeping your password to yourself if you connected with one.
You can connect an account with Sign in with Apple, Sign in with Google, or an email address and password. Whichever you use, you must be entitled to use that account. Do not sign in with someone else's.
If you play anonymously and lose your device, your progress cannot be recovered. There is no record connecting that installation to you, which is the point of it being anonymous. Connecting an account is the only protection against this, and it is why the app offers it.
If you have been playing anonymously on this device and then sign in to an account you already had, the runs recorded here are moved onto that account and the anonymous identity is deleted. Nothing is duplicated. No score is recalculated: every run keeps the result it was given when you played it, and a run that did not count towards the leaderboard before does not start counting because it moved.
This is one-directional and it only ever absorbs an anonymous identity. We will not merge two accounts that both belong to real sign-ins, in either direction, because deciding which one's records survive is not a decision we can make correctly on your behalf.
Play fairly about this. Moving scores you earned yourself is what the feature is for. Deliberately using it to move somebody else's scores onto your account is a breach of section 8, and we may remove the affected scores or suspend the account.
Coins are a feature of the game. They are not money.
If you buy coins with real money, Apple or Google processes the payment and their refund rules apply. Once coins are spent inside the game, that spend is final.
A few things you can buy with coins give you more of a run than you had earned — an extra shot in Fling, or an Aegis in Glide that breaks through a column instead of ending the run. A run that used one of those still earns coins, and still earns milestones, but it does not count towards the leaderboard.
This is deliberate. The leaderboard is meant to measure how well you played, and a board where a bigger balance buys a higher place measures something else. Which purchases do this is always stated on the buy button before you spend anything, never discovered afterwards, and buying one never affects any run other than the one you are playing.
Your drawings are yours. We do not claim ownership of anything you make in Arkadia.
Drawings you keep to yourself stay on your device.
Publishing is an explicit choice, available only to players aged 13 or over. By publishing a drawing you:
The licence lasts as long as the drawing is published. You can unpublish it at any time and we will stop distributing it, but we cannot retrieve copies already downloaded to other players' devices, and other players may keep using copies they already have.
You keep every other right in your drawing and can do whatever else you like with it.
If you import one of your own photos to use as artwork, that artwork is permanently private to your device. It cannot be published, sold, shared, gifted, or synced, not for money, not for free, not ever.
This is enforced in the app, not just promised here. The app records at the moment of creation whether artwork was drawn or imported, and only drawn artwork can ever leave your device.
We do this because a photograph can contain another person, someone else's copyrighted work, or something that should not be distributed at all, and none of that becomes acceptable simply because no money changed hands.
If you publish a design, it must not:
The same rules apply to your display name.
As the app stands, there is almost nothing to moderate. No player can publish a design, send you anything, or write anything you will read. The one piece of text another player can put in front of you is the display name beside their score on the leaderboard.
Today: press a name on the leaderboard to report it. Names are also checked when they are set, and one that is clearly offensive is refused before anyone sees it — no such check catches everything, which is why the report button is there too. We can suspend the account, which removes that player from every leaderboard immediately.
When publishing arrives: every published design will be reportable from inside the app, and every creator blockable so you never see their designs again. Those features ship together with publishing, not before it.
We read everything that reaches us and act on it as quickly as we can, by removing content that breaks these rules and by suspending or removing the account responsible. Serious matters, anything involving a child, or a credible threat, are escalated to the appropriate authorities.
We have deliberately stopped promising a 24-hour response time. Arkadia is run by one person, and a number we cannot always hit is worth less than an honest description of what we do — a commitment you break is worse than one you never made.
We may remove any design, at any time, with or without a report, and we do not have to explain the decision. We would rather remove something borderline than leave it up.
We are not obliged to monitor everything published, and we do not promise to find everything that breaks the rules before someone reports it. We do promise to act when we know.
Arkadia may let players publish designs for other players to use, and earn coins when they do. This section covers that whether or not it is switched on yet.
Publishing and browsing published designs are available from age 13. Under 13, the marketplace is not shown at all.
Only designs you drew yourself, with the drawing tools in this app. Artwork made from an imported photo can never be published, see section 4. Designs must follow the content rules in section 5.
Publishing a design costs a fee in coins. The fee is destroyed, not paid to us, it exists so that publishing is a decision rather than a reflex, and so that the marketplace does not fill with work nobody meant to share.
Fees are not refunded if a design is later removed or unpublished.
When another player obtains one of your published designs, you receive coins.
If we remove three of your published designs for breaking these terms, you permanently lose the ability to publish. You keep full access to the games, to the drawing tools, and to obtaining designs other players have published.
You can unpublish a design at any time and we will stop distributing it. We cannot recover copies already downloaded to other players' devices, and other players may keep using copies they already have. Coins already earned are not reversed when you unpublish.
Deleting your account (section 13) unpublishes your designs.

We may suspend or terminate your access for breaking these rules, and remove cheated scores from the leaderboard.
Leaderboards are public. If you connect an account and post a score, your display name and best score are visible to every other player. Playing without an account keeps you off the board entirely, and your scores stay on your device.
The leaderboard is meant to reflect skill. Runs are checked for plausibility, and a score that could not have been achieved in the time it claims will be excluded.
Buying things does not take you off the leaderboard. Almost every purchase in Arkadia keeps your run ranked and pays for itself by deducting points at the moment you buy it, scaled to how far into the run you are. You spend score you have already earned, at the rate the game gave it to you.
The one exception is anything that buys extra attempts, which currently means extra shots in Fling. Those runs still earn coins but are not ranked, because an extra attempt does not merely add its own score. It stops the run ending, and a run that does not end can score without limit. The app tells you which is which before you buy.
Your display name must follow the rules in section 5. We may reset, adjust or remove leaderboard entries, and we may remove a name, to keep the board meaningful.
We may send you announcements about the app, new games, updates, planned maintenance, events, and reminders about daily rewards.
You control which of these you receive, by category, in Settings → Notifications. Turning a category off stops that kind of message; it does not stop the app working, and it does not stop you finding the message later if you go looking for it.
There are two places a message can appear, and you control them separately.
Inside the app, on the Announcements screen. This needs no permission.
As a push notification, delivered by your device even when Arkadia is closed. Push is off until you switch it on, your device asks your permission the first time, and you can refuse. To send you one we store an address for your device and the list of categories you agreed to; turning off every push category deletes both. The Privacy Policy explains this in full.
Some messages are operational rather than optional, if the service is down or something you paid for did not arrive, we may still tell you inside the app.
We do not use notifications for advertising, and we do not send them on behalf of anyone else.
You can contact us from inside the app. Support messages reach us and nobody else. We read them, but we cannot promise to reply to every one, or to build every game that gets suggested.
If you send us an idea or suggestion, we may use it freely and without owing you anything for it. Please do not send us ideas you want to keep or be paid for.
Arkadia will change. Games will be added, balance will be tuned, and features may be removed. We may change how coins are earned or what things cost, and we may stop offering the app entirely.
If we change these terms in a way that affects you, the app will ask you to accept the new version rather than quietly updating this page.
You can stop using Arkadia at any time, and delete everything from Settings → Delete my account.
We may suspend or end your access if you break these terms. Sections 3, 4, 11 and 14 survive the end of this agreement.
No warranties. Arkadia is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or free of harmful components.
Limited liability. To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost coins, scores, drawings, or data. Where liability cannot be excluded, our total liability is limited to the greater of what you paid us in the twelve months before the claim, or twenty US dollars.
Your responsibility for what you publish. You are responsible for the designs you publish. To the extent the law allows, you agree to indemnify and hold us harmless against claims, damages, and reasonable legal costs arising from a design you published, from your breach of these terms, or from your violation of someone else's rights.
Some places do not allow these exclusions, in which case they do not apply to you, and you may have rights these terms cannot take away. Nothing here removes a right you have under the consumer law of your country.
Governing law. These terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law rules, and the courts located there have exclusive jurisdiction, except where the law of your home country requires otherwise.
Severability. If any part of these terms is unenforceable, the rest continues to apply.
Entire agreement. These terms and the Privacy Policy are the whole agreement between you and us about Arkadia.
